Package tour cancellation facts I

Facts about the cancellation and the amount of the cancellation costs:

  • Cancellation conditions / percentage lump sums in case of cancellation often set too high (even if the organizer refers to his terms and conditions)
  • Savings of the tour operator in case of a cancellation are often not passed on to the customer (e.g. hotel, transfer service, flight reservation)

The following points should be considered before submitting your case

Please note that enforcement on this legal basis applies exclusively to package holidays. A package holiday is defined as a trip consisting of at least two offered and packaged services, e.g., flight + hotel.

The cancellation fee is not always subject to incorrect calculations. However, you as a customer have the right to be informed and to request an explanation about the composition of the cancellation fee. Therefore, taking a closer look at this often pays off financially.

Please note that we can only work for you if your trip has already been canceled and cancellation fees have been paid. You must therefore have already fulfilled your contractual obligation and have already paid the cancellation fees in full or, if necessary, proportionately (e.g. only the down payment).

NoShow cannot prevent the basic collection of cancellation fees in advance, as these are usually partly legitimate.

We can not act for you if a cancellation insurance has already compensated your damage.

  1. After submitting your case, you will immediately receive an automatic e-mail with your transmitted data and attachments – for reasons of transparency, as well as a NoShow case number for any queries. If this has not been received within a few minutes, we ask for a short feedback immediately. (Check your spam folder as well)
  2. After filing the case, NoShow will contact you and provide you with the free initial assessment of the chances of a subsequent reimbursement
  3. NoShow will send you a power of attorney, including terms and conditions and cancellation policy, detailed process, and the next steps
  4. After we have received the signed power of attorney, our lawyers will send the brief to the provider and protect your rights
  5. NoShow always informs you about news, as well as case developments by e-mail (on request also by phone)
  6. If a repayment is successfully enforced out of court or in court, NoShow will inform you immediately on the same day the money is received and the successful case with you in accordance with settle the agreed success commission What does NoShow cost?

You are welcome to submit the cancellation confirmation later, as processing by the tour operators is sometimes delayed. However, you will normally receive at least an email indicating the amount of the costs.

Through groundbreaking and precedent-setting court rulings in favor of travelers and the insurance industry, NoShow has laid the foundation for a fairer cancellation practice.

The most important court rulings include:

  • NoShow vs. FTI Group: (Case No. BGH X ZR 88/20, BGH X ZR 89/20, BGH X ZR 90/20, BGH X ZR 92/20, BGH X ZR 93/20): These rulings paved the way for insurers to successfully enforce recourse claims transferred to them (pursuant to § 86 VVG) against tour operators, avoid unjustified cancellation fees, and significantly reduce loss ratios.
  • Frankfurt District Court (Case No. 32 C 2136/20): A landmark ruling clarifying the protection of consumer rights during the COVID-19 pandemic.

Cancellation fees for a package tour * are subject to legislation and are therefore bound by certain regulations.

Decisive for this is the new EU Package Travel Directive 2015/2302, as well as the judgment of the Federal Supreme Court file number X ZR 13/14.

The tour operator** has the right to cover the costs incurred by the booking/cancellation by charging a cancellation fee in the terms and conditions. In many cases, however, the amount turns out to be unreasonably high and the general terms and conditions do not correspond to the organizer’s actual claim for compensation. In some cases, due to the market power of the respective organizer, the service providers incur lower or no cancellation fees or service components of your trip are sold again to another traveler. These savings are often not reflected in the flat rates charged and these turn out to be excessive.

Travel agencies often function only as agents of so-called holiday package tours, but can also act as a tour operator on their own. However, this is not very common.
