Your passenger rights: flight delays, cancellations, denied boarding

While travelling, you have probably heart statements like these: „ Flight XY to … is estimated to be delayed by 3 hours.

Due to recent events: Please note that outbreaks of war, earthquakes, or strikes in the public sector / public transport / railways, as well as the resulting airport closures, do NOT give rise to any entitlement to compensation from the airline. These situations are not the fault of the airline and are beyond its sphere of influence.

Expection: For flight cancellations outside of extraordinary circumstances (e.g., strikes by Lufthansa cabin crew, airline ground staff, etc.), the airline must still be held accountable, and you are entitled to compensation!

The entitlement to compensation is regulated by EU Passenger Rights Regulation (EC) No. 261/2004, which defines passengers’ rights in the event of denied boarding, flight cancellation, or long delays (including missed connecting flights due to the delay) and specifies the amounts.

In these cases the regulation applies: For all EU flights / EU airlines

Arrival at the destination airport occurs with a delay of at least three hours. This also applies in cases where an earlier delay caused you to miss a connecting flight and you also arrived at the destination airport with a delay of at least three hours.

Did you know?

Technical problems, poor planning, crew illnesses, or issues within the airline’s responsibility do not exclude your entitlement! Unfortunately these regulations do not cover damagescaused by storms, strike, bird strike or the lock down of an airport. As well as not for a non-EU airline, that starts outside the EU.

Usually, many airlines talk about seemingly plausible, yet legally incorrect statements around a compensation payment.

Often times, you do not even get a response to your complaint, as this is a part of the airlines’ usual tactics.

However, do you know your rights from the associated supreme court judgments in order to enforce your claims? – Unfortunately, most travelers do not know these and the effort to obtain them is extensive.

Approximately 15% of passengers request compensation.

Only 2-4 % of passengers actually receive compensation.

Unfortunately, the rest of the passengers are not aware of their rights.

3.8 billion EUR in compensation is not being claimed in Europe annually!

Every third delayed flight departs or arrives in Germany – are you also one of the millions affected?

Ultimately, they try to compensate for their incorrect planning in the airspace and in the processing with the waiting time of the passengers.
