Your passenger rights: flight delays, cancellations, denied boarding
While travelling, you have probably heart statements like these: „ Flight XY to … is estimated to be delayed by 3 hours.
The reason for that is the delay of the previous flight – we kindly ask for your understanding“ or „My flight was scheduled to arrive yesterday at 18:45, we had to spent one night at the airport and had no idea what time we would finally depart.“
First, a problem with the previous flight is mentioned, then it is suddenly a simple delay and finally they are speaking about „force majeure“, although you are at the gate and the aircraft is being repaired. Often these statements are simply false, but what is the reason for this defensive behavior of airlines?
It is the entitlement for compensation under the European Regulation (EC) No 261/2004, which regulates the rights of passengers in the event of denied boarding, cancellation or long delays (even if you missed due to the delay your connecting flights).
Note: The Corona pandemic / Covid-19 is also considered an exceptional circumstance by the EU Commission in the communication dated March 17, 2020. You currently have no right to compensation based on the Passenger Rights Regulation due to flight cancellations.
However, this does not exempt the airline from reimbursing you the ticket price.
In these cases the regulation applies: For all EU flights / EU airlines
Flight delay / missed connecting flight
Arrival at destination airport more than three hours late. This also applies to cases with a previous delay, as a result of which the connecting flight was missed and you also arrived at the destination airport with a delay of at least three hours.
Canceled flight (by the airline)
Your flight was cancelled on short notice or less than 14 days before the departure by the airline
Overbooking
You were at the gate on time, but were booked to a later flight due to overbooking.
All EU-Flights / EU-Airlines
All flights with departure and destinations within the EU, as well as EU-airlines departing e.g. from the US or Australia with the destination within the EU.
